Une personne re\u00e7oit, de la Caisse de retraite, son relev\u00e9 de carri\u00e8re ainsi qu\u2019une \u00e9valuation de sa future pension de retraite. Le courrier mentionne une date \u00e0 laquelle cette personne pourra b\u00e9n\u00e9ficier d\u2019une retraite \u00e0 taux plein, fix\u00e9e 2 ans plus tard.<\/p>\n

L’objet du litige<\/h3>\n

Cependant, il s\u2019av\u00e8re que l\u2019information est erron\u00e9e, ou du moins incompl\u00e8te, car cette personne peut, en r\u00e9alit\u00e9, b\u00e9n\u00e9ficier imm\u00e9diatement d\u2019une retraite anticip\u00e9e pour carri\u00e8re longue. Elle prend alors sa retraite et r\u00e9clame \u00e0 sa Caisse une indemnisation. Elle consid\u00e8re, en effet, qu\u2019en commettant cet impair, la Caisse n\u2019a pas respect\u00e9 son obligation d\u2019information \u00e0 son \u00e9gard.<\/p>\n

Le verdict<\/h3>\n

Mais le juge ne donne pas suite \u00e0 sa demande : la Caisse n\u2019est pas oblig\u00e9e de rechercher, de sa propre initiative, si le futur b\u00e9n\u00e9ficiaire d\u2019une pension de retraite est \u00e9ligible \u00e0 un dispositif sp\u00e9cifique de retraite anticip\u00e9e pour carri\u00e8re longue. Elle n\u2019a donc pas manqu\u00e9 \u00e0 son obligation d\u2019information\u2026 et l\u2019assur\u00e9 ne peut alors pr\u00e9tendre \u00e0 aucune indemnisation.
