Un conducteur est bless\u00e9 dans un accident commis par un autre conducteur qui n\u2019a pas respect\u00e9 un feu rouge. Parce que ce dernier fuyait la police, l\u2019assureur du conducteur bless\u00e9 estime\u00a0que la responsabilit\u00e9 de la police est engag\u00e9e. Ce que conteste cette derni\u00e8re\u2026<\/p>\n

L’objet du litige<\/h3>\n

\u2026 \u00e0 tort, pour l\u2019assureur du conducteur bless\u00e9 : il rappelle que la Loi pr\u00e9voit qu\u2019est, par principe, impliqu\u00e9 dans un accident tout v\u00e9hicule intervenu \u00e0 un titre quelconque dans sa\u00a0survenance. Ce qui est le cas ici puisque le conducteur fautif \u00e9tait poursuivi par la police. \u00ab Pas exactement \u00bb conteste la police qui rappelle qu\u2019au moment de l\u2019accident, son v\u00e9hicule\u00a0avait cess\u00e9 de poursuivre le conducteur fautif. Sa responsabilit\u00e9 ne peut donc pas \u00eatre engag\u00e9e.<\/p>\n

Le verdict<\/h3>\n

Sauf que le conducteur fautif pensait toujours \u00eatre poursuivi par les policiers qui avaient enclench\u00e9 l\u2019avertisseur sonore. Le v\u00e9hicule de police est donc, selon le juge, effectivement\u00a0impliqu\u00e9 dans l\u2019accident : la police doit alors indemniser le conducteur bless\u00e9.<\/p>\n
