Une mutuelle va toutefois verser le capital provenant d\u2019une garantie d\u00e9c\u00e8s souscrite par le d\u00e9funt \u00e0 la m\u00e8re de ce\u00a0dernier.<\/p>\n<h3>L&rsquo;objet du litige<\/h3>\n<p>\u00ab Une erreur \u00bb, estime la compagne, puisque le capital lui est d\u00fb en vertu du testament de son compagnon. Sauf que le contrat relatif \u00e0 la garantie d\u00e9c\u00e8s pr\u00e9voit que le capital est \u00ab hors succession \u00bb, r\u00e9pond la m\u00e8re du d\u00e9funt. En\u00a0outre, le contrat\u00a0souscrit ne mentionne aucun b\u00e9n\u00e9ficiaire du capital.<\/p>\n<p>Or, ce contrat pr\u00e9voit une d\u00e9signation automatique du b\u00e9n\u00e9ficiaire, dans cette situation : il r\u00e9sulte de cette clause que c\u2019est \u00e0 elle de percevoir le capital, faute\u00a0pour son fils de laisser derri\u00e8re\u00a0lui une veuve (ce que la concubine n\u2019est pas), une partenaire de pacs (ce qu\u2019elle n\u2019est pas non plus) ou des enfants.<\/p>\n<h3>Le verdict<\/h3>\n<p>\u00ab Pas d\u2019erreur \u00bb, r\u00e9pond le juge \u00e0 la concubine : le capital \u00e9tant \u00ab hors succession \u00bb, la mutuelle a eu raison de le verser \u00e0 la m\u00e8re du d\u00e9funt.<\/p>\n<blockquote>\n<p><em><span class=\"s1\">Source\u00a0: Arr\u00eat de la Cour de Cassation, 1<\/span><span class=\"s2\"><sup>\u00e8re<\/sup><\/span><span class=\"s1\">\u00a0chambre civile, du 14 mars 2018, n\u00b0 17-14384<\/span><\/em><\/p>\n<\/blockquote>\n<\/div>\n\n\n<p class=\"has-small-font-size\">En partenariat avec Weblex<\/p>\n","protected":false},"excerpt":{"rendered":"<p>C\u2019est l\u2019histoire d\u2019une femme et d\u2019une belle-m\u00e8re qui se disputent\u2026 Un homme d\u00e9c\u00e8de et laisse un testament instituant sa concubine \u00ab l\u00e9gataire universelle \u00bb de tout son patrimoine.
