Un testament sans valeur juridique, pour les fr\u00e8res et s\u0153urs du d\u00e9funt\u2026<\/p>\n<h3>L&rsquo;objet du litige<\/h3>\n<p>Ils rappellent que le testament dont se pr\u00e9vaut la partenaire du d\u00e9funt pr\u00e9voit que les 2 pacs\u00e9s se l\u00e8guent mutuellement tous leurs biens\u00a0\u00e0 leur d\u00e9c\u00e8s. Or, le legs \u00e9tant mutuel, il s\u2019agit d\u2019un \u00ab testament conjonctif \u00bb, interdit par la Loi. Le testament est donc nul. \u00ab Non \u00bb\u00a0r\u00e9pond la partenaire du d\u00e9funt : l\u2019interdiction du testament conjonctif repose sur la volont\u00e9 d\u2019\u00e9viter que le testateur ait agi sous\u00a0influence et de pr\u00e9server sa facult\u00e9 de r\u00e9vocation du testament. Or, la volont\u00e9 du d\u00e9funt a perdur\u00e9 jusqu\u2019\u00e0 son d\u00e9c\u00e8s, ce qui d\u00e9montre\u00a0qu\u2019il n\u2019\u00e9tait pas sous son influence.
