Une femme sollicite l\u2019autorisation d\u2019abandonner le nom de famille de son p\u00e8re pour celui de sa m\u00e8re. Demande rejet\u00e9e par le Minist\u00e8re de la justice, ce que la demanderesse ne comprend pas, au regard des circonstances particuli\u00e8res de son\u00a0histoire\u2026<\/p>\n

L’objet du litige<\/h3>\n

Mais le Minist\u00e8re de la justice persiste : pour changer de nom, il faut justifier d\u2019un int\u00e9r\u00eat l\u00e9gitime, ce qui n\u2019est pas le cas ici, consid\u00e8re-t-il. \u00ab Faux \u00bb r\u00e9torque \u00e0 son tour la femme : elle rappelle qu\u2019elle a seulement \u00e9t\u00e9 \u00e9lev\u00e9e par sa m\u00e8re, ayant\u00a0\u00e9t\u00e9 abandonn\u00e9e par son p\u00e8re \u00e0 l\u2019\u00e2ge de 4 ans ; depuis, elle n\u2019a plus jamais eu de contact avec lui, ce dernier n\u2019ayant subvenu ni \u00e0 son \u00e9ducation, ni \u00e0 son entretien, malgr\u00e9 des injonctions judiciaires. Ces circonstances exceptionnelles\u00a0caract\u00e9risent, selon elle, un motif d\u2019ordre affectif, justifiant un int\u00e9r\u00eat l\u00e9gitime au changement de nom de famille.<\/p>\n

Le verdict<\/h3>\n

Ce que valide le juge : la femme justifiant d\u2019un int\u00e9r\u00eat l\u00e9gitime, elle peut substituer le nom de famille de sa m\u00e8re \u00e0 celui de son p\u00e8re.<\/p>\n
