Une femme, qui se rend sur la s\u00e9pulture de son beau-fr\u00e8re, inhum\u00e9 quelques jours plus t\u00f4t, tombe dans une\u00a0fosse\u00a0voisine, creus\u00e9e la veille et seulement recouverte d\u2019une t\u00f4le, et se blesse. Elle r\u00e9clame alors des\u00a0indemnit\u00e9s \u00e0 la soci\u00e9t\u00e9\u00a0qui a creus\u00e9 la fosse\u2026<\/p>\n

L’objet du litige<\/h3>\n

La femme rappelle que la soci\u00e9t\u00e9 n\u2019a pas entour\u00e9 la fosse de barri\u00e8res ou ne l\u2019a pas couverte par un plancher\u00a0solide, afin\u00a0d\u2019\u00e9viter les accidents, comme le lui impose pourtant le r\u00e8glement municipal. \u00ab C\u2019est vrai \u00bb, conc\u00e8de la\u00a0soci\u00e9t\u00e9. Sauf que\u00a0la femme a commis une faute ayant concouru \u00e0 la r\u00e9alisation de son pr\u00e9judice, en p\u00e9n\u00e9trant\u00a0dans le cimeti\u00e8re en dehors\u00a0des heures d\u2019ouverture au public, alors que le jour n\u2019\u00e9tait pas encore lev\u00e9, et en ne\u00a0circulant pas dans les all\u00e9es\u00a0pourtant pr\u00e9vues \u00e0 cet effet. De quoi limiter sa responsabilit\u00e9, estime la soci\u00e9t\u00e9\u2026<\/p>\n

Le verdict<\/h3>\n

\u00ab Vous avez raison \u00bb confirme le juge : si la femme a droit \u00e0 des indemnit\u00e9s, son comportement justifie effectivement que la responsabilit\u00e9 de la soci\u00e9t\u00e9 soit au \u00be exon\u00e9r\u00e9e.<\/p>\n
