Une fois \u00e0 bord, il allume un r\u00e9chaud \u00e0 gaz\u2026 qui\u00a0prend feu ! Le\u00a0plaisancier le lance alors \u00e0 la mer et le r\u00e9chaud \u00e0 gaz tombe \u00e0 pic. Mais une nappe de gaz enflamm\u00e9 s\u2019en \u00e9chappe\u00a0soudain et endommage le\u00a0bateau amarr\u00e9 \u00e0 c\u00f4t\u00e9 de celui du plaisancier.<\/p>\n<h3>L&rsquo;objet du litige<\/h3>\n<p>M\u00e9content, le propri\u00e9taire du bateau endommag\u00e9 r\u00e9clame une indemnisation pour le pr\u00e9judice subi. Il explique que le plaisancier a\u00a0commis\u00a0une faute d\u2019imprudence en jetant le r\u00e9chaud \u00e0 gaz enflamm\u00e9 \u00e0 c\u00f4t\u00e9 de son bateau. Faute que r\u00e9cuse le plaisancier : selon\u00a0lui, il n\u2019est pas\u00a0possible, d\u2019une part, de lui reprocher d\u2019avoir jet\u00e9 son r\u00e9chaud enflamm\u00e9 dans la mer, et d\u2019autre part, de ne pas avoir\u00a0pr\u00e9vu qu\u2019une nappe\u00a0de gaz enflamm\u00e9e s\u2019en \u00e9chapperait et br\u00fblerait un bateau\u2026<\/p>\n<h3>Le verdict<\/h3>\n<p>\u2026 \u00e0 tort pour le juge : le plaisancier a commis une imprudence fautive en lan\u00e7ant \u00e0 la mer un r\u00e9chaud enflamm\u00e9 pr\u00e8s d\u2019un bateau qui a \u00e9t\u00e9 endommag\u00e9.
